My dog and Me

I've just finished the movie " Marley and Me", basically it talks about the 13 years journalist John Grogan and his family shared their life, home and heart with Marley, a goofy, neurotic, over sized, yellow Labrador Retriever . Its based on a real story written by the master himself and it is a New York Time bestselling autobiographical book. The newly-wed couple decided to adopt a dog before starting a family. i got watery eyes because of the teary ending! i had a pet and it died because he had been poisoned by some bad bad guys. i have read and seen so many things about dog recently, people abuse dogs, throw the dogs into river, et cetera et cetera. what i know is, they're really loyal like what John said in a discussion on his website devoted to the book, he looks back on his family's time with Marley, and the lessons learned, and concludes that: " Commitment matters. That 'in good times and bad, in sickness and in health' really means something. We didn't give up on Marley when it would have been easy to, and in the end he came through and proved himself a great and memorable pet." 


             I just saw a video about the owner was shot and died in a violent robbery on the street. A dog reluctant to leave the body. His eyes, were so helpless and sad. Finally the body was carried away, and the dog still refused to leave. Its so heartbroken to see a situation like this, dog. John said : " owing a dog always ended with this sadness because dogs just don't live as long as people do." But in this case, it's another way round! Dogs, they do not have wings, they're furry and always shake their tail.  they're like angels in heaven, helping people in silence, don't expect anything in return. But still, there are a lot people do not understand.


           Its true that, "a dog has no use for fancy cars, big homes, or designer clothes. A water log stick will do just fine. A dog doesn't care if you rich or poor, clever or dull, smart or dumb. Give him your heart and he will you his. How many people can you say that about? how many people can make you feel rare and pure and special?how many people can make you feel extraodinary?" John Grogan.

Claim back your pay as part-timer!

After being scolded by my roomie that i should write something "useful" here!  
ok ok la, sometimes i don't have the mood to start anything relates to law, cause i feel like i'm writing my assignments. I have just finished 2 assignments in the past 2 weeks, feel like: "yuckssss...", like you have been eating the same dishes over and over again for 2 weeks, and you're going to eat it again...
"yucks..."

                  Back to the topic, as a past-timer, the most frustrating nevertheless it still happens all the time-- employer delay in payment or default in payment. i have heard some cases that, some of them only get their pay after half a year or one year. it's ridiculous! Now, Malaysian part-time workers are governed by new regulations which is The Work Regulations ( Part-Time Workers) 2010  in the Employment Act 1955. The new regulation would apply to some 12mil existing workers from both private and public sectors with another 6.5mil latent workforce in the country. The new regulations aim to better regulate and protect part-time workers. 
A worker is a part-time worker for the purposes of the regulations if he is paid wholly or partially by reference to the time that he works, and cannot be identified as a full-time worker when compared to other workers on the same type of contract. The rights are exercisable by complaint to an Employment Tribunal. 

               According to s2 of Employment Act 1955, 'part time employee' means a person who works average hours as agreed between him and his employer do not exceed 70% of the normal hours of work of a full time employee which are 8 hours a day and 40 hours per week.

             According to section 3 of the said regulations, these regulations shall not apply to a part-timer who works less than 30 % of the normal working hours in one week, ( based on employment act, normal working hours= 8 hours per day, one week 40 hours); home working employee & who works within the employee's residence( for example, maid).

             Before you claim your pay from your employee, make sure the total amount of your pay and also dates which you work. Its necessary to provide them some evidential facts before claiming. For any overtime which means work done in excess of the "normal hours of work". However it does not include work done on Rest Days and Public Holidays. Overtime on normal working days not less than 1 1/2 time the normal hourly rate of pay. Lets take an example, lets say you will get RM 100 per day ( exclude any extra allowance, this is the basic pay), therefore 100/8 hours = RM 12.5 per hour. OT = 3 hours. Therefore, 3 x RM 12.5 x 1.5= RM 56.25. You are entitled to RM 156.25 that day.  The maximum working hours are 104 hours per month, unless exempted by the Minister under Section 2B or not more than 12 hours of work per day ( include the normal hours in a day), if not, you can file a complaint against your employer to Labour Department Malaysia.

            According to the regulation 5(2), the employer who fail to pay any part-time employee for OT commits an offence and shall be liable to a fine not exceeding RM 10,000. 

           As for Holidays, every part-time employee shall be entitled to a paid holiday, four of them will be (according to regulation 6) : national day, Birthday of YDPA, birthday of the Ruler or YDPN, or the Federal Territory Day, the worker's day and on any day declared as a public holiday under s8 of the Holiday Act 1951.  2 days wages regardless that the work done on that day is less than their normal hours plus their public holiday pay [Regulation 6(6)(a)]. Example: RM 100 x2 = RM 200. if overtime on Public Holidays, 3 times the hourly rate of pay for work done in excess of normal hours of work[ Regulation 6(6)(b)]. Example, RM 12.5 x 3 x 3 hours (OT) = 112.5, total = RM 312.50.  Any employer who failed to pay, will be liable to a fine not exceeding RM 10,000.
                    
               If employer default in payment, under section 19 of Employment Act, employer shall within 7  working days after last day of wage period pay the employee the wages earned by such employee. Meaning that, if the employee get his wages on 17th June 2010, then the latest time he can get next month wages would be 18th + 7 working days of July. Lets say the 18th is Wednesday, then he can file his complaint against the employer to Labour Law department after 27th of July. I'm not sure what practice are they using right now, this is what i found out that :The Labour Law department will issue a legal demand letter to such employer and command him to pay within 14 days. After 14 days, second letter will be issued as a last reminder to employers to pay up the overdue contributions. After sending 2 reminder letters and if there was still no response from the employers, the case would be forwarded to the inspectors who would then visit the defaulting employers to assess and collect arrears of contributions. If fail, the last resort will be that the employer would be referred to the legal Department for prosecution. The employer will be charged in the Courts, in most cases the Courts would order the employers to settle the arrears in installments, in other matters, will follow according to  The Work Regulations ( Part-Time Workers) 2010  in the Employment Act 1955.

Let me rephrase it again:
1. Confirm the total amount of your pay and your working dates
2. Remind your employer regarding the pay after 7 working days
3. if there is still no response from employer, file a complaint against your employer to Labour Law Department or refer it to your lawyer.
4. A demand letter will be issued to your employer to pay up the overdue contributions within 14 days.


Employer should not give excuses for delaying payment, as employee, we work on your request, we do our part, complete our work, we deserve our pay! Now is you to do your part and give us what we deserve!!its our right to claim and to receive pay!

New Year 2011 party: it's all about food & alcohol!

            well, after half a month, i'm finally writing this.. First, i got no mood to start any writing after New Year cause i had 2 assignments were pending that time , Secondly, i got no time for it..i always tell myself this, if i got time for blogging why not i spend my precious time on assignment? Being a 3rd year student, i realize that i'm getting lazier and lazier!!Before this i would usually spend at least 1 week to prepare my assignment, now only 3 days AT MOST to settle all things... ya, you can imagine the QUALITY of my assignment.. @@ Chinese New Year is around the corner, have you guys prepared for it?new clothes, new shoes, new bag..new bra & new unties, i don't understand why everything has to be new. New boyfriend also ya ? *winks* hahaha...
               I spent my new year at my uncle's place, they prepared lots of food... YA, it's insane! and I COULDN'T EAT! *%$#@#$& .... because my mouth was being wired shut for 2 weeks, and i was forced to take liquid diet! arrrhhh... it was killing me! imagine that i was hungry and exhausted, because liquid did not provide enough nutrient and my naughty cousins keep teasing me and showing me how tasty the food were... the temptation... arrrhh!!! the worst 2 weeks in my life! I let you feel my pain now!

Anyway, back to real life! School started and tones of assignments and homeworks await me! grrrr.... *depressing* After so many weeks of liquid diet, i think i kind of obsessed with that! SHIT!! 
Anyway, Chinese New Year is around the corner, Huuu~~ ang pao time! teeheee!
